Life of a Personal Injury Case (Pre-Lawsuit)
This guide is intended to provide a general overview of the normal life of a personal injury case before a lawsuit is filed in Wisconsin. It will help you understand what to expect at each stage of the pre-lawsuit process. Onboarding
After you sign the Engagement Letter, we contact you to gather key details and advise the insurance company of our representation. From this point on, we handle communication about your injury claim.
Evidence & Treatment
We begin collecting evidence while you focus on medical treatment. Keep us updated on your progress. We typically check in at least every couple of months: but we are always happy to get updates from you. Avoid speaking with the insurance company directly. If anyone contacts you regarding the accident, provide them with our contact information so we can handle all communications for you.
Medical Records (30-90 days after treatment is completed)
Once treatment is complete, we order and organize all medical records and bills (usually 30–90 days). There may be less communication during this phase while we gather everything needed.
Demand (Typically 60-120 days)
We prepare and send a demand package outlining your injuries, treatment, and damages, then follow up to push for a timely review.
Negotiation (30–120 days)
We negotiate with the insurance company to maximize your recovery and minimize what goes to liens or medical bills.
Resolution
If we can reach a fair settlement with the insurance company that meets with your approval, we finalize it and distribute the funds.
